Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the Site and any content, digital products, online programs, memberships, communities, features, and services offered by the Company (collectively, the “Services”). By accessing or using the Site or Services, you agree to these Terms.
If you do not agree, do not use the Site.

Eligibility

You must be at least 18 years old (or the age of majority where you live) to use the Site and Services.

Changes to These Terms

We may update these Terms from time to time. Updates take effect when posted on the Site. The “Last Updated” date reflects the latest version. Your continued use after changes means you accept the updated Terms.

Accounts & Access

Some Services may require an account, login credentials, or purchase.
You agree to:

  • provide accurate account and purchase information;

  • keep your login credentials confidential; and

  • accept responsibility for all activity under your account.

We may suspend or terminate access if we reasonably believe your account is being used fraudulently or in violation of these Terms.

Purchases, Billing, and Payment Processing

When you purchase a Service, you authorize us (and our third-party payment processors) to charge your payment method for the amount displayed at checkout, including applicable taxes.

  • Prices: Subject to change at any time.

  • Payment processors: We use third parties to process payments; your purchase may also be subject to their terms and policies.

  • Chargebacks: Initiating a chargeback or payment dispute without first contacting us to resolve the issue may result in immediate suspension of access to Services while the dispute is investigated.

Digital Products, Programs, Memberships & Community Access

Your purchase may include access to digital course materials, downloads, live or recorded calls, worksheets, assessments, and/or a private community.
Unless otherwise stated at checkout:

  • Digital materials are delivered electronically.

  • Access duration (time-limited vs. ongoing) will be stated on the sales or checkout page.

  • We may update, replace, or remove portions of the Services over time.

No sharing / no reselling: Your access is personal to you. You may not share login credentials, distribute materials, or allow others to use content you purchased.

Refund Policy

Refund terms, if offered, will be disclosed on the checkout page, sales page, or in the specific program agreement presented at purchase, and those terms are incorporated into these Terms by reference.
Unless we state otherwise in writing, all purchases are final and non-refundable, including digital downloads and access to online programs and communities (since access is delivered immediately and cannot be “returned”).

Community Rules (Required for Access)

If your purchase or account includes access to any community space (Discord, Circle, Facebook group, in-app community, forums, chats, comments, etc.), you agree to the following:
You will not:

  • harass, threaten, or shame others;

  • post hateful, discriminatory, or violent content;

  • share private personal information of others (“doxxing”);

  • spam, solicit, or promote unrelated products/services without permission;

  • post illegal content or infringe intellectual property;

  • upload malware or attempt unauthorized access;

  • share confidential community content outside the community.

Enforcement: We may remove content and/or suspend or terminate community access at our discretion for violations. If access is terminated for conduct violations, you are not entitled to a refund unless required by law.

Health, Fitness & Educational Disclaimer (No Medical Advice)

The Services provide education and informational coaching and are not medical advice, mental health advice, diagnosis, or treatment.
You understand and agree that:

  • Always consult a qualified healthcare provider before beginning any exercise, nutrition, or lifestyle program.

  • If you experience pain, dizziness, shortness of breath, or other concerning symptoms, stop immediately and seek professional care.

  • Results are not guaranteed; outcomes vary by individual.

  • You are responsible for your choices, actions, and results.

If you are in crisis or believe you may harm yourself or others, contact local emergency services immediately.

Intellectual Property

All content on the Site and within the Services—including trademarks, logos, program names, videos, text, worksheets, assessments, graphics, design elements, and course structures—is owned by the Company or licensed to the Company and is protected by intellectual property laws.
Limited license: We grant you a limited, revocable, non-transferable, non-exclusive license to access and use purchased materials for your personal, non-commercial use only.
You may not reproduce, distribute, sell, sublicense, create derivative works, or publicly display our content without written permission.

User Content & Permission to Use Feedback

If you submit content to us or within our community (comments, posts, testimonials, assignments, survey responses, etc.) (“User Content”), you represent you have the rights to submit it.
You grant the Company a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and display User Content for operating and improving the Services.
Testimonials: If you provide a testimonial or review, you give permission for us to use it for marketing, unless you notify us in writing to remove it. We will not share your private information beyond what you provide or approve.

Prohibited Uses

You agree not to:

  • use the Site or Services for unlawful purposes;

  • violate or attempt to violate Site security;

  • scrape, crawl, or use automated means to access the Site without permission;

  • impersonate any person or misrepresent affiliation;

  • use our content to create a competing product or service.

Third-Party Links and Tools

We may link to third-party websites or use third-party tools (payment processors, email platforms, video hosting, community platforms, etc.). We are not responsible for third-party content, availability, or practices. Use third-party services at your own risk.

Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, timely, secure, or error-free.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEURODISCIPLINE, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR SERVICES.
IN NO EVENT WILL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR $100 IF YOU PAID NOTHING), UNLESS A DIFFERENT LIMIT IS REQUIRED BY LAW.

Indemnification

You agree to defend, indemnify, and hold harmless NeuroDiscipline, LLC and its owners, employees, contractors, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site/Services, your User Content, or your violation of these Terms.

Termination

We may terminate or suspend your access to the Site or Services at any time if we reasonably believe you violated these Terms, engaged in fraud, or misused the Services. Sections that should logically survive termination will survive.

Governing Law and Venue

These Terms are governed by the laws of the State of Kansas, without regard to conflict of law rules.
Unless prohibited by law, any dispute arising from these Terms or the Services will be brought exclusively in the state or federal courts located in [County], Kansas, and you consent to personal jurisdiction there.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, along with any policies referenced (including the Privacy Policy and any checkout/program-specific terms), constitute the entire agreement between you and the Company regarding the Site and Services and supersede prior agreements related to the Site and Services.
